Common slapped with a lawsuit

Songwriters Andrew Marks and London McDaniels filed a lawsuit against Rapper Common claiming he stole their song "When Will The Day Come" in his song "Take it EZ."

But here's the problem, Common whose real name is Lonnie Rashid Lynn, Jr., gives Marks and McDaniels credit on the downloadable version of  the song "Contains samples from: When Will The Day Come.'"

According to TMZ.com, “Here's the problem: The credit don't pay the rent. So Marks and McDaniels are suing for unspecified damages.”

Is  Common is a thief? Why haven't they been paid for their contribution?

We think Common may have shot himself in the foot on this one.
